Jefferson County Commission decides to delay bankruptcy decision again al.com (blog)

I actually listened as the agreement was read and debated point-by-point. There are major problems, including 1) requiring damaged, non-working septic tank users to connect to the sewer system(think about the tornado homes); 2) all creditors would no longer be held liable for anything(many ongoing lawsuits against JP Morgan and the rest); 3 rates increases in 18 months that would probably total 25%; 4) contingencies on many, many Alabama legislative actions; 5) contingent on IRS, SEC, other government agencies finding no wrongdoing w/JP Morgan and creditors(JeffCo has no control of this); 6) contingent upon interest rate on June 2012; 7) $250M escrow-like funded by JeffCo to help people who can't pay rate increases(JeffCo would have to borrow the money and the fund would help pay the rate increase portion of the bill, not the bill. These are just a few. The proposal was a trap full of contingencies failure any one of which would invalidate the "agreement". The Sept 16 deadline was the date proposed for final agreement by the creditors. The decision to table it until then was with the idea, via proclamation, that JeffCo negotiate with the creditors, not Young, and that the proceedings be totally transparent. It really helps to see the events as they unfold as I was in favor of accepting the agreement based on what I had heard before the meeting. After viewing the meeting and hearing proposal point-by-point ther is no way the proposal could be approved. NO WAY!!!!

As long as you have been in bankruptcy for 12 months and have a written letter from the judge you can go FHA at any bank.

I want to refinance my two year fixed mortgage. I'm in a Chapter 13 bankruptcy. Any good companies for this?

I have been with the same mortgage company for almost four years. I started with an adjustable mortgage. After two years the rates and payments shot up. I modified with them to a two year fixed. This expires in August. Last November, I filed a Chapter 13 bankruptcy, which includes the mortgage. My attorney says to either work on another modification with the company I have, or to seek out a refinance somewhere else. Has anyone out there been in similar situations? What did you do? Any recommendations on a good company to go with?


My sister refinanced with Countrywide after filing bankruptcy. That was a few years ago so I don't know how they are now but you might call and talk to them.


I would love to help you! However...your approval will boil down to what your home is worth & the size of loan amt. you need to pay off your mortgage & your BK. So if those all check out to be 85% loan to value & you have a fico of 580 & higher...your loan is a slam dunk!

what you can do is a bankruptcy buyout. depending on your LTV and house value you can take out another loan for the price of your house and use it to pay off your current outstanding debts. as long as you HAVE NOT gotten your notice to sale for your house then you still have time. some banks will allow up to 1 120day late payment and still be able to help you out. the rate will not be very good but at this point and time it should be the last of your concerns.


Tough spot, if you have any equity you may be able to get something done. Try quicken loans they are pretty good, your rate is going to be through the roof no matter who approves you.

I don't think that is necessarily true. If you did not include the mortgage on the bankruptcy and have a good history on paying the mortgage, no late payments etc. I would start with the company that currently holds your mortgage. You may have to pay a higher rate because of the bankruptcy but that does not mean that they will not refinance it.


Yes, with today's tighter guidelines, one will need to wait between 2-3 years before getting a home loan or refinancing. This is why it's important to get a fixed rate. One thing to note, if you're home was included in the bankruptcy, your credit may report the home as a foreclosure--in which you'll have to wait longer than 3 years.

It's a good idea to have someone pull your credit after a bankruptcy to make sure all of the accounts that were supposed to be included where, in fact, included.

I filed for bankruptcy in 2004 and I have been paying on it for so long now that I have a chance to pay it on out. I have about a year left to go if I don't pay it on out. I want to refinance my house. If I pay my bankruptcy and my case is discharged, how long shall I wait before applying for a loan to refinance my home?


You can refi once it has been discharged since you are more than 24 months out from your filing date. You will need proof that the BK has been discharged. Once you have this, you can get what is called an Expanded Approval Loan. Lots of the big mortgage company's offer this product (Countrywide, Beneficial, GMAC...). A lot of whether you qualify for this loan will depend on whether or not you have had any deliquency or derogatory credit since your filing date. If you have paid everything on time since 04, the you are probably good to refi as soon as you get the discharge papers. If you have had credit issues since then, the it will probably take an additional 12-24 months after discharge to get a refi.

It sounds like you are in chapter 13 BK. Normally you have to wait until you are two years out of bankruptcy before refinancing on a conventional or fha loan. If you want any additional information pertaining to this question, feel free to shoot me an email.


Sounds like you are in a Chapter 13. You can buy while in a Chapter 13 if the court approves. I would think you could refinance also with court approval. Hopefully you only want a rate reduction, not a cash out.


Of the three banks I've worked for in the last 10 years, all require discharge of a BK. Each also required at least 2 years since filing. One went by the credit score if those requiements were met, but another required 1. a GOOD reason for the BK (divorce and loss of job were not acceptable, someone needed to get sick or die), 2. NO lates or missed payments since filing, and 3. that bank didn't lose any money. I can't remember any more details about the last one. Talk to your bank, see what they do.

Lets see, you just screwed several creditors out of several thousands of dollars and you want to refinance your home? I guess your lawyer forgot to mention one of the consequences of filing bankruptcy. Your credit is screwed for the next 7-10 years. Forget about any kind of loan for quite some time.

Yes. If you can find a lender that is willing to finance you while in a chapter 13 bk, you need to submit the paperwork to your attorney handling your chapter 13 case. They submit it to the courts for the trustee to approve. Any re-financing or financing of any kind while in a chapter 13 is the final say thru the trustee. Usual process takes about 30 days. So, if the lender is willing to re fi for you, advise them it could be at least 30 days as it takes at least that long to get the trustees approval. Good Luck!
