My ex and I have joint car loan, but only her name is on title in Wisconsin. She is forcing me to take car!?

She is trying to give me no choice but to take car. She demands I pay for all insurance, full car payment etc. She says if I dont she will come with police to get car... I would let her take it, but am worried about credit. She cannot refinance in her name as well as I cant in just mine. I am willing to compromise with her but she gives me no choices.

Legally I am only liable for half the car payment, and nothing else I think... Right?


you are correct. if the loan is defaulted because neither of you pay you are both on the hook for the money. the rest of it sounds like she is being an unreasonabe bitch and you should not give into her gold digging demands.

*** actually you are resonsible for the whole car payment in a way. if she does not pay any of it you have to pay all or have the loan default. the loan company does not care who pays and will not accecpt "here is my half, my ex will pay the rest." it will be all or nothing and if she decides she doesn't want to pay anymore then either you will have to pay it or be screwed credit wise. sorry


Im not fully aware of the laws in Wisconsin, but in most states disputed common property has to be sold, and the proceedes split between the two parties. IF her name is on the title, then its her car. The debt is a mutual responsibility. This is another example why a good divorce lawyer is worth their weight in gold.

You should take the car while you have a chance at control of the situation. She could quit making payments (if she is currently) and leave your credit bad. You said that you have the car. If so, you are getting all the benefits so why should she be paying anything? You made an original mistake by having the title in her name and all the payments and such in both names. She holds all the aces right now as far as being able to obtain the car and still ruin your credit.

The loan presumably puts a lein on the car - they hold the title - to be sure they get payments. How did her name get on the title all by itself? If a court was involved, then go back to the court and get it changed. Put a recorder on your phone to make a record of her calls (you can in Texas if only one person in conversation knows of recording, check in Wisconsin)

Me and my girlfriend broke up 6 months ago(never married)I have been paying on two car loans for almost six months that are in both of our names on loan, however thay are titled in just hers(refinanced about a year ago after she owned them solely)
I only possess one of the cars, which she threatens to come take whenever she gets mad. Now that I have a new girlfriend, she is REALLY MAD, and vindictive.

I have no intentions on defaulting on the loan and I am fully aware the bank doesnt care/ thay just want their money. But I am technically paying for her car, and what if she does take it back??? What are legal options in court, and what is it called. I do not even want the car either, I have only been paying on it, because I am legally liable on the loan.

I do not feel comfortable paying for this car, two years from now when it is paid off she could just take it, and their isnt anything I could do. please help???


Your right, if the car is titled solely in her name and you both pay it off, you will still not have legal rights to that car.
Your also right about the bank not caring how they get their money. They just want it. Your issue with the car title and or loan is between you and her and if the police if they should happen to get involved.
You need to work on getting your name off the bank loan. How? I can't offer my opinion on that.
Bottom line, your exposing yourself to being responsible for a car loan and never having any rights to the car.
You or your current girlfriend could be using the car and if your ex called the police about the car, they could make you give up the car right then and there. I doubt the police would be interested with who's name is on the loan papers just who's name is on the title. When you financed the car, if both names were on the loan (primary signer & co signer) both names should be on the title. When you refinanced you should not have taken your name off the title if your name was on the loan. Get off the loan papers, You can be held responsible for a loan and never have any legal rights to the property.


The first thing you need to do is go get your name off of anything she is in possession of, and in return, get her name off of anything that is in your possession. It doesn't matter if you were married or not, if your name is anywhere on anything, you will be just as responsible if she were to decide to not make a payment or something. I have friends that have been screwed over big time because they were stupid and didn't get this done.


I was in the same predicament last year. Me and my then boyfriend bought a car which we were both paying then. When we broke up we had an agreement to sell the car and divide the money equally to us. At the end, he didnt sell the car, didnt give me any of my share, and took it off with his girlfriend. The girlfriend even called me names because I was trying to get what was mine. At the end, I inquired thru an attorney and was not able to get anything. The car was named after him. We didnt make any documents making me an owner of the car too. We just made it mutual. Bottomline, I was not able to get anything.

However, I am not in the States. I hope you could still work that out and get your rightful share with the property. Good Luck!
